Thank you for your interest in using our website www.adlermode.com.
Protecting your privacy is very important to us. We provide below detailed information about how we handle your data. Adler Modemärkte AG, Industriestrasse Ost 1-7, 63808 Haibach, Germany (hereafter “ADLER” or “we”) is responsible in terms of data protection for processing your personal data in connection with the website www.adlermode.com. In this context, we will process your personal data for the purposes stated in this privacy notice.
We will only process your data in accordance with the applicable data protection requirements of the EU General Data Protection Regulation 2016/679 (“GDPR”), the German Federal Data Protection Act (“BDSG”), and other applicable data protection regulations. In doing so, we guarantee the protection of your personal data, in particular through technical and organisational security measures that comply with current security standards.
1. Access data and hosting
You can visit our website without providing any personal information. Every time you use our website, the web server automatically stores a so-called server log file, which contains, for example, the name of the requested file, your IP address, the date and time of use, the amount of data transferred, and the requesting provider (access data), and documents the retrieval. This access data is evaluated solely for the purposes of ensuring trouble-free operation of the website and improving our product. In accordance with Art. 6 (1) sentence 1 letter f) GDPR, this is necessary for the purpose of the legitimate interests we pursue in connection with the correct presentation of our product, which is our primary concern in the context of balancing interests. All access data are deleted seven days at the latest after your visit.
A third party provides the services for hosting and displaying the website on our behalf. This is necessary for the purpose of the legitimate interests we pursue, which predominate in the context of balancing interests in the correct display of our offer in accordance with Art. 6 (1) sentence 1 letter f) GDPR. All data collected as part of the use of this website or in intended forms in the online shop as described below will be processed on its servers. Processing on other servers takes place only in the context explained here.
The third party service provider is located within a country of the European Union or the European Economic Area.
2. Data collection and use for contract execution and opening a customer account
We collect personal information you voluntarily provide to us as part of your order, when contacting us (e.g. using a contact form, chat, or e-mail), or when opening a customer account. Obligatory fields are marked as such, since in these cases the information is needed to execute the contract, to process your contact request, or to open a customer account and it is impossible to do any of these things without this information. The respective input forms show the data collected. We use the data you provide in accordance with Art. 6 (1) sentence 1 letter b) GDPR for the performance of a contract or to process your requests in accordance with Art. 6 (1) sentence 1 letter f) GDPR, as we have a legitimate interest in being able to answer your inquiries about our goods and services. Unless you have expressly consented to the continued use of your data or we reserve the right to the further use of your data, if legally permitted and we have informed you of this in the context of this notice, your data will be restricted for further processing and deleted upon expiry of the retention periods required under tax and commercial law once the contract has been fully executed or your customer account is deleted. Deleting your customer account is possible at any time and can be done either by sending a message to the point of contact provided below or using the intended feature in your customer account.
3. Data transfer
We will also pass on your personal data to third parties for the purposes of initiating and executing the purchase agreement. The data this involves depends on the particular payment method you have requested that we offer. Depending on which payment method you select in the order process, we will forward the collected payment data to the payment institution responsible for the payment and, if applicable, any payment service providers we have commissioned or the selected payment service.
Credit check when using unsecured payment methods for your payment
In principle, we also offer you the opportunity to purchase goods by invoice, direct debit or credit card, or cash on delivery (unsecured payment methods).
Since we are providing a service in advance in this case, it is necessary for us to obtain identity and credit information from a specialised service company (credit reporting agency). Therefore, we will provide your data (gender, first and last name, date of birth, and address if available) to said credit reporting agency for the purpose of a credit check, to receive information to aid in the risk assessment of payment default on the basis of mathematical/statistical methods using address data, and to verify your address (deliverability check). This only happens if you select an invoice, direct debit, credit card, or cash on delivery payment method. The legal bases of these transfers are Art. 6 (1) letter b) and Art. 6 (1) letter f) GDPR. Processing your data is lawful, since it pertains to the beginning of a purchase agreement. In addition, we have a legitimate commercial interest in avoiding payment defaults (credit check) and/or fraud through the use of incorrect or non-existent order data (deliverability check) in the context of making purchases using unsecured payment methods.
As part of the credit check, you are subjected to a decision based on automated processing, which is permissible in accordance with Art. 22 (2) letter a) GDPR. The credit information may contain probability values (so-called score values). Any score values included in the results of the credit rating are based on a scientifically recognised mathematical/statistical procedure. The calculation of score values may include, but is not limited to, address data.
In accordance with Art. 14 GDPR, detailed information about the credit reporting agencies, that is, information about the business purpose, the purpose of data storage, data recipients, the right of access by the data subject, and the right to erasure or rectification can be found on the website of these companies.
Internal credit check
In addition, we conduct an internal credit check before accepting payments for goods using unsecured payment methods. For this purpose, we use credit information that we have either collected from you or that credit reporting agencies or debt collection agencies have transmitted to us. Credit information includes information about your customer rating (e.g. gold customer, existing customer) as well as information about outstanding compensation claims and information that directly poses a risk of default (such as bankruptcy, debt counselling, etc.). Our internal credit check also includes information about atypical orders, such as the simultaneous ordering of a large number of goods to the same address using various customer accounts. If our internal credit check returns a negative result, we cannot offer you an unsecured payment method. You will then be presented the opportunity to pay for the goods by means of advance payment, Sofortüberweisung, gift card, or in person at an ADLER branch (Click and Collect service).
Your data is processed for the internal credit check on the basis of Art. 6 (1) letter b) GDPR and Art. 6 (1) letter f) GDPR. In principle, we have a legitimate interest in ensuring the goods are paid for if an unsecured payment method is selected.
Payment service providers
You may pay for goods in our online shop using an external payment service provider. The payment service provider you select processes data that is absolutely necessary for payment processing. This may include especially your first and last names, address, account or credit card numbers, associated passwords, TANs, or check numbers. We do not receive any actual account or credit card information, only information with a confirmation or information that negatively impacts payment. As part of the fulfilment of contracts, we use payment service providers on the basis of Art. 6 (1) letter b) GDPR. Otherwise, we use external payment service providers on the basis of our legitimate interests in accordance with Art. 6 (1) letter f) GDPR to offer our users effective and secure payment options.
Cash on delivery
In Germany and Austria, you may also pay cash on delivery. In this case, payment is made upon delivery of the goods through the shipping company DHL. To fulfil the contract in this case, we must provide the shipping company with your first and last names along with your address.
When making payment by advance payment/bank transfer, you transfer the payment amount to our bank account by the specified deadline. We treat the bank details we receive as a result of the transfer with strict confidentiality.
You may also pay for the goods using Amazon Pay, an external payment service provider. In this case, Amazon Payments Europe s.c.a., located at 5 Rue Plaetis, L-2338 Luxembourg performs processing for this payment method.
For our checkout page, we use a service from Sovendus GmbH, located at Moltkestr. 11, 76133 Karlsruhe, Germany (www.sovendus.de). Once you have completed your purchase in our online shop, you will also be shown a number of different coupon offers as well as regionally relevant promotional offers.
To present a selection of coupon offers which may be of interest to you, we will send the hashed value of your e-mail address and your IP address to Sovendus in a pseudonymised and encrypted form (Article 6 (1) letter f) GDPR). The pseudonymised hash value of the e-mail address will be used to take into account any possible opposition to advertising from Sovendus (Art. 21 (3), Art. 6 (1) letter c) GDPR). Sovendus uses the IP address exclusively for data security purposes and, as a rule, the data is anonymised after seven days (Art. 6 (1) letter f) GDPR). In addition, for billing purposes, we transmit the pseudonymised order number, order value with currency, session ID, coupon code, and time stamp to Sovendus (Article 6 (1) letter f) GDPR). If you are interested in a coupon offer from Sovendus, click on the coupon banner displayed in this specific case. We will then encrypt your address, name, and e-mail address and send this data to Sovendus for preparation of your coupon (Art. 6 (1) letter b), Art. 6 (1) letter f) GDPR). Please note: the banner will not be displayed if you use an ad blocker for your e-mail account.
We will ship your goods to the address you have provided to us, unless you have opted for our Click and Collect service. The data required for delivery will be sent to the shipping company responsible for the delivery. This is necessary for contract performance in accordance with Art. 6 (1) letter b) GDPR.
If you have purchased goods by invoice or by direct debit and have not paid any outstanding amounts in spite of written reminders, we may sell and assign the claim to a collection agency and/or authorise the collection agency to collect the claim. For this purpose, we will need to share your details (first and last name, date of birth, address, telephone number, e-mail address, claim amount, and invoice number) with the collection agency. This transfer of data is lawful in the case of a direct debit authorisation, since this is included in the purpose of the contract performance pursuant to Art. 6 (1) letter b) GDPR. In the case of factoring, the transfer of your data is lawful in accordance with Art. 6 (1) letter f) GDPR, because we have a legitimate interest in selling outstanding receivables.
4. E-mail newsletter and postal advertising
E-mail advertising with registration for the newsletter
Postal advertising and your right of objection
In addition, we reserve the right to use your first and last names as well as your postal address for our own promotional purposes, for example, to send relevant offers and information about our products by mail. This is necessary for the purpose of the legitimate interests we pursue, which predominate in the context of balancing interests in presenting offers to our customers in accordance with Art. 6 (1) sentence 1 letter f) GDPR. We commission a service provider with the processing of such advertising mailings. For this purpose, we will provide your information to the service provider. You can object to the storage and use of your data for these purposes at any time by sending a message to the point of contact described under point 10.
5. Integration of the Trusted Shops trustbadge
To display our Trusted Shops quality seal and reviews we have collected as well as to offer Trusted Shops products to buyers after an order, the Trusted Shops trustbadge is integrated into this website.
This is necessary for the purpose of the legitimate interests we pursue, which predominate in the context of balancing interests in the optimal marketing of our offer in accordance with Art. 6 (1) sentence 1 letter f) GDPR. The trustbadge and the advertised services are an offer from Trusted Shops GmbH, located Subbelrather Str. 15C, 50823 Cologne, Germany. When using trustbadge, the web server automatically stores a so-called server log file, which contains, for example, your IP address, the date and time of use, the amount of data transferred, and the requesting provider, and which documents the retrieval (access data). This access data is not evaluated and are automatically overwritten within seven days after the end of your page visit. Other personal data will only be transferred to Trusted Shops if you have consented to this, have decided after the completion of an order to use Trusted Shops products, or have already registered for use. In this case, the contractual agreement between you and Trusted Shops applies.

User profiles are created from the collected data using pseudonyms. In the following, we name the companies, whose services we use for this purpose, describe the special features of these services, if applicable, and provide you with a link you can use to opt out of the respective service.
Our website uses services from intelliAd Media GmbH, located at Sendlinger Str. 7, 80331 Munich, Germany (www.intelliad.de). For the evaluation and improvement of our approach to promotions, we provide the following data to intelliAd if you have an online customer account: customer number, gender, age and country. In addition, we can also pass on purchase data that is collected when you purchase an ADLER loyalty card in one of our ADLER branches, such as your customer number, the store location where you made the purchase, and the purchase amount. This helps us to better understand your shopping behaviour and present you with targeted offers. You can deactivate cookies from this company by clicking on this link.
For website analysis, this website uses technologies from Webtrekk GmbH, located at Robert-Koch-Platz 4, 10115 Berlin, Germany (www.webtrekk.com). Based on the data collected when you visit our online shop, for example, customised banners are displayed to you. You can deactivate these cookies by clicking on this link.
Google Analytics and Google AdSense
For website analysis, this website uses Google Analytics, a web analytics service of Google LLC, located at 600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereafter: “Google”). The information the cookie automatically collects about your use of this website is usually transmitted to a Google server in the USA and stored there. By activating the IP anonymisation on this website, the IP address is truncated before being transmitted within the member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US where it is truncated. The anonymised IP address that your browser sends as part of Google Analytics will generally not be merged with other data from Google.
Our website markets space for third party and ad-serving networks through Google AdSense. These ads appear in different places on this website. As part of the integration of Google AdSense, the so-called DoubleClick cookie from Google is placed for all site visitors. This allows the display of interest-based advertising by automatically assigning a pseudonymised user ID; this helps determine the interests of visitors to this and other websites.
Google LLC is based in the US and is certified under the EU-US Privacy Shield. A current certificate can be viewed here. Under the agreement between the US and the European Commission, the latter has established an appropriate level of data protection for companies certified under the Privacy Shield.
You can prevent Google from collecting and processing the cookie-generated data related to your use of this website (including your IP address) by downloading and installing the browser plugin available under this link. As an alternative to the browser plugin, you can click this link to prevent detection by Google Analytics on this website. An opt-out cookie is placed on your device.

For product discovery, especially search and navigation, we utilise the services of FINDOLOGIC GmbH, located at Jakob-Haringer-Str. 5a, 5020 Salzburg, Austria (www.findologic.com) on our website. Product discovery uses data analytics to respond to your personal needs and preferences. Cookies are used to store information about you and various data are transmitted to the service provider. These include especially the IP address and browser identification, as well as related behaviour data such as search queries, visited categories, selected filters, and viewed and purchased products. Caching takes place without exception to detect possible click fraud (bot detection). You can deactivate this service by clicking this link.
6.1.6. Cookies for remarketing and prospecting purposes
We use remarketing and prospecting technologies from external service providers on the pages of our online shop. Remarketing and prospecting enable us to tailor our online offer to you and make it more interesting. From studies we know that the display of personalised and interest-based advertising is more interesting for the Internet user than advertising that has no such personal reference.
Remarketing allows us to display specific ads on partner websites for the products you have already shown an interest in when previously visiting our online shop. Some of the cookies we use are also used for prospecting. Prospecting, in contrast to remarketing, is not designed to promote products you have already viewed on third party websites, but rather to make you aware of offers from other partner websites in accordance with your product references.
For remarketing and prospecting purposes, companies that we commission will place cookies which collect interest data on your device using pseudonyms. This information is used to display interest-based advertisements about our products on our partners’ websites. Personally identifiable information is not stored and user profiles are not merged with any personally identifiable information about you.
In the following, we name the companies whose services we use for this purpose, describe the special features of these services, if applicable, and provide you with a link you can use to opt out of the respective service.

Google AdWords remarketing
Our website uses the services of Google Adwords from Google LLC. We use Google Adwords to promote our online shop’s products in Google search results and on third party websites. Google places a so-called remarketing cookie for this purpose when you visit our website. This involves analysing your interaction with our website, for example, tracking which offers interest you for the purpose of displaying targeted advertising on other websites after visiting our website.
6.1.7. Cookies for purposes of affiliate marketing
For the correct recording of sales and/or leads, we use the services of affilinet GmbH, located at Sapporobogen 6-8, 80637, Germany (www.affili.net/de/). The utilised cookie is placed by the domain parners.webmaster-plan.com or banners.webmasterplan.com. Affilinet cookies store only the ID of the intermediary partner as well as the serial number of the advertising material the visitor clicks (banner, text link, etc.); these are required for payment processing. When concluding a transaction, the partner ID is used for allocating the commission to be paid to the intermediary partner. Details on privacy can be found at: www.affili.net/de/datenschutz. We use “Facebook Pixel” from Facebook Inc., located at 1601 S. California Ave, Palo Alto, CA 94304, USA, to form so-called “custom audiences”. A direct connection to the Facebook servers is established when utilising our services via Facebook Pixel. Your visit and the pages viewed are transmitted to the Facebook servers. In addition, individual information and parameters required to optimise our ads, increase relevance, and measure success are transferred. This includes especially information about so-called “conversion events” (e.g. whether a registration or a purchase has taken place).
In the event that personal information is transferred to the US, Facebook has submitted to the EU-US Privacy Shield. A current certificate can be viewed here. Under the agreement between the US and the European Commission, the latter has established an appropriate level of data protection for companies certified under the Privacy Shield.
6.3 Online presence on Facebook
For the Store Finder feature, our website uses the map service Google Maps from Google LLC. To integrate and display Google Maps on your browser when your browser queries the contact site, the website must be able to connect to a Google server, which may also be located in the United States. Google receives the information that the contact page on the website was viewed from the IP address associated with your device. In the event that personal information is transferred to the US, Google has submitted to the EU-US Privacy Shield.
The Store Finder allows you to use location data to search for nearby ADLER stores and display them in Google Maps. You can enter address data in a search field (postal code or city and/or street name). If you only want to search for stores nearby, you can also use the Store Finder’s automatic locate feature by clicking the “Nearby Stores” button. This activates the HTML5 “Geolocation” feature for automatic location determination, which all common browsers support. Before your browser determines the location, you must explicitly allow this for privacy reasons by accepting the execution of this feature. Depending on which browser and which device you use, your IP address, received signals from WLAN networks, and – especially if you are using a mobile device – GPS, and cellular signals are used for the subsequent location determination. The address data you enter in the search field of the Store Finder or the location your browser automatically determines are transmitted to Google via an interface, so the ADLER branches found in the vicinity can be displayed in Google Maps.
The legal basis for this data processing is Art. 6 (1) f) GDPR on the basis of our legitimate interests, in particular the provision of the Store Finder described above and the optimal marketing of our website and ADLER branches.
8. YouTube video plugin
Our website integrates components of the service YouTube. YouTube’s operating company is YouTube LLC, located at 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube LLC is a subsidiary of Google Inc., located at 1600 Amphitheater Pkwy, Mountain View, CA 94043-1351, USA.
Each time you visit any of the pages on this website that incorporate a YouTube component (YouTube video), the specific YouTube component will automatically prompt the browser on your device to download a representation of the corresponding YouTube component from YouTube. As part of this technical process, YouTube and Google are aware of the specific subpages of our website that you are visiting.
If you are logged into YouTube at the same time, YouTube recognises which specific subpage of our website you are visiting containing a YouTube video. YouTube and Google collect this information and associate it with the individual YouTube account. If you are logged into YouTube when you access our website, YouTube and Google always receive the information via the YouTube components that you have visited our website; this happens regardless of whether you click on a YouTube video or not. If you do not wish to transfer this information to YouTube and Google, you can prevent this by logging out of your YouTube account before using our website.
9. E-mail evaluation reminders
If you grant us your express consent in accordance with Art. 6 (1) sentence 1 letter a) GDPR, we will send you e-mail reminders to submit an evaluation of your order using our rating system. This consent can be withdrawn at any time by sending a message to the contact option provided below.
